Terms of Use

These Terms of Service ("Terms") govern your access to and use of the YardNest mobile application ("App"), operated by LeadsUp LLC FZ, Grand Stand, Nad Al Sheba, Dubai, U.A.E., PO Box 9573 ("Company", "we", "us", "our").

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of the Service

The App is a visualization tool for garden and landscape planning. It provides:

  • AR Plant Placement: placing 3D models of plants, trees, shrubs, and flowers into a live camera view of your real space, and moving, rotating, and scaling them.
  • AR Surface Drawing: marking out areas on real surfaces — for example a lawn, gravel bed, paving, mulch, or decking — and previewing them with a selected texture.
  • Plant Catalog: a browsable library of plants with 3D models, images, and descriptive reference information.

The App works by rendering computer graphics over your camera view. It does not use artificial intelligence, does not analyze or interpret what your camera sees beyond the surface tracking performed by your device's operating system, and does not transmit your camera view anywhere. The App does not perform face detection, face recognition, or any biometric identification.

The App is a visualization and reference tool only. We are not a nursery, garden center, landscaping contractor, or horticultural advisory service.

2. Eligibility

You must be at least 13 years old (or the minimum legal age required in your jurisdiction) to use the App. By using the App, you represent that you have the legal capacity to enter into these Terms.

3. Device Requirements and Permissions

AR features require a compatible device supporting ARKit (iOS) or ARCore (Android), sufficient lighting, and camera permission. Some features, such as depth-based occlusion, require a device with a LiDAR or depth sensor. We do not guarantee that every feature will be available on every device, and support for older devices may end without notice.

Camera access is used solely to render the AR view on your screen, as described in our Privacy Policy.

4. Safety While Using AR — Please Read Carefully

Augmented reality draws your attention to your screen and away from your surroundings. You are solely responsible for your own safety and the safety of those around you.

  • Stay aware of your surroundings. Look up frequently. Watch for traffic, other people, animals, water, drops, holes, tools, and uneven or slippery ground.
  • Never use the App while driving, cycling, or operating machinery.
  • Do not use the App near roads, water, cliffs, construction sites, or any hazardous area.
  • Supervise children. Do not allow young children to use AR features unattended.
  • Respect others. Do not point your camera into other people's property, windows, or private spaces, and comply with all applicable privacy and trespass laws.
  • Stop if you feel unwell. Prolonged AR use can cause eye strain, dizziness, disorientation, or nausea in some people. If you have a history of seizures, epilepsy, or vestibular disorders, consult a physician before use.

5. Accuracy and Reliance Disclaimer

5.1 AR is an approximation. Surface detection, scale, distance, and area measurements produced by the App depend on your device's sensors, lighting, surface texture, and how you move the device. They are approximate and may be significantly wrong. Do not rely on the App for measurements, quantities, or purchasing decisions. Verify all dimensions and areas physically before ordering materials, plants, or labor.

5.2 Models are representations. The 3D models in the catalog are stylized or generalized representations. A real plant will differ in size, shape, color, density, and seasonal appearance, and will change as it grows. The App does not simulate growth, seasons, weather, or plant health over time.

5.3 Catalog information is general reference. Descriptions such as mature size, hardiness zone, sun and water requirements, growth rate, bloom period, and toxicity are provided for general information only. They are compiled from general sources, may contain errors, and cannot account for your soil, climate, microclimate, drainage, or local conditions. They are not horticultural, agricultural, veterinary, medical, or landscaping advice.

5.4 Consult professionals. Before planting, consult a local nursery, landscape professional, or extension service. Where relevant, consult a qualified professional regarding:

  • Toxicity. Many ornamental plants are toxic to children, pets, or livestock if touched or ingested. Verify before planting.
  • Allergies. Pollen and sap from some plants cause allergic or dermatological reactions.
  • Invasive and regulated species. Some plants are legally restricted, prohibited, or invasive in certain regions. It is your responsibility to check local law.
  • Site safety. Before digging, locate underground utilities, irrigation lines, and cables through the appropriate local service. Consider root systems near foundations, drains, paving, and septic systems.
  • Permits and rules. Local regulations, homeowners' association rules, tenancy agreements, protected-tree ordinances, and heritage restrictions may limit what you can plant or build.

6. Your Content

Screenshots, videos, and project layouts you create with the App belong to you. Because these are stored only on your device and are never transmitted to us, we claim no rights in them and grant no license over them.

If you share images created with the App publicly, you are responsible for ensuring that doing so does not violate anyone's privacy or other rights.

7. Intellectual Property

All rights, title, and interest in the App — including the software, the AR rendering engine, the user interface and design, the plant catalog and its descriptive content, and all 3D models, meshes, materials, textures, and other assets ("Assets") — are owned by or licensed to the Company.

You are granted a limited, personal, non-exclusive, non-transferable, revocable license to use the App and to view the Assets within the App for your own planning purposes.

You may not:

  • extract, rip, dump, intercept, decompile, or otherwise obtain the Assets or catalog data outside of the App;
  • reverse engineer the App or its network protocols, or access our servers by any means other than the App itself;
  • redistribute, resell, sublicense, or publish the Assets, or use them in any other application, game, rendering, asset library, dataset, or product;
  • use the Assets or catalog data to train, fine-tune, or evaluate any machine-learning or AI model;
  • use automated means to scrape, crawl, or bulk-download our catalog.

You may use screenshots and video recordings of the App's AR view for personal, editorial, and non-commercial purposes, including sharing your own garden plans on social media, provided you do not present the Assets as your own work.

8. Prohibited Use

You agree not to:

  • use the App in violation of any applicable law;
  • use the App to record, photograph, or observe other people or private property without consent;
  • interfere with, overload, or attempt to gain unauthorized access to the App's infrastructure or servers;
  • bypass usage limits, paywalls, licensing checks, or security measures;
  • distribute modified versions of the App.

9. Purchases and Subscriptions

The App may offer paid content or subscriptions, which may include weekly or yearly plans and trial periods.

All purchases:

  • are billed via the Apple App Store or Google Play,
  • are charged to your Apple ID or Google account,
  • automatically renew, in the case of subscriptions, unless canceled at least 24 hours before the end of the current period.

You can manage or cancel subscriptions in your Apple ID or Google account settings after purchase. Refunds are handled exclusively by Apple or Google in accordance with their store policies; we do not issue refunds directly.

Catalog content may be added, changed, or removed over time. We do not guarantee that any particular plant, model, or texture will remain available.

10. Privacy

Your use of the App is governed by our Privacy Policy, which forms an integral part of these Terms. In summary: your camera feed, AR surface data, and designs never leave your device, and we share nothing with advertisers, data brokers, analytics providers, or AI services.

If you are located in the EEA, you have rights regarding access, correction, deletion, restriction, and portability of your personal data. California residents have rights to know, delete, and opt out of the sale or sharing of personal data; we do not sell or share personal data. Details are in the Privacy Policy.

11. Termination

We may suspend or terminate access to the App at any time if these Terms are violated, applicable laws are breached, or misuse of the service is detected. You may stop using the App at any time by uninstalling it.

12. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or uninterrupted availability.

13. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for indirect or consequential damages, loss of data or profits, or damages arising from your use of or inability to use the App.

Without limiting the foregoing, the Company shall not be liable for: any injury, accident, or property damage occurring while you use AR features; any inaccuracy in measurements, areas, scale, or catalog information; any purchase, planting, construction, or landscaping decision you make based on the App; the death, poor performance, or unsuitability of any plant; harm caused by plant toxicity or allergens; or any fine, penalty, or dispute arising from local planting regulations. Your sole remedy is to discontinue use of the App.

14. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any third-party right, including any intellectual property, property, or privacy right.

15. Changes to These Terms

We may update these Terms from time to time. Changes take effect upon posting within the App or the store listing. Continued use constitutes acceptance of the updated Terms.

16. Dispute Resolution

16.1 Informal Resolution

If you have any dispute with us, you agree to first contact us at [email protected] and attempt to resolve the dispute informally.

16.2 No Class Actions

To the fullest extent permitted by applicable law, you agree that any disputes arising out of or related to these Terms or the App will be conducted only on an individual basis and not in a class, consolidated, or representative action.

17. Governing Law

These Terms are governed by the laws of the United Arab Emirates, specifically the laws of the Emirate of Dubai, without regard to conflict of law principles.

For EU/EEA Consumers:

Notwithstanding the above, if you are a consumer habitually residing in the European Union or European Economic Area, the laws of your country of residence may apply to any claim or dispute you have against us that arises out of this agreement, and you may be entitled to the consumer protections provided by the mandatory laws of your country of residence. Nothing in these Terms limits your rights to rely on such mandatory local law provisions.
